To current member residents who have decided to relocate, the Association's Board wishes you and your family well during this time of life changes.
As you are aware, all homes within the Mountain Glen community are individually owned and thus home sales are arranged in the normal manner between the seller and purchaser. However, because each real estate property includes an automatic mandatory membership, the Association becomes involved during each property transfer. The mandatory membership places the community under the control of the Property Owners' Association Act (POAA). The POAA is a comprehensive legal framework that governs community associations in the state of Virginia. It is important that either the seller(s) or real estate agent request a Resale Certificate when deciding to transfer ownership of the real estate property. This request is made to ensure that the potential buyer(s) are fully informed about the financial and legal standing of the community and the property itself.
Before selling your home, please consider the following steps to ensure a smooth closing sale:
Review your governing documents.
Make sure you're current in your member annual assessment (dues).
Prepare your property for sale within HOA guidelines.
Communicate your decision to the Association's Board so that they may update their membership records.
Request or have your selling agent request a Resale Certificate through the Association's managing company and familiarize yourself with the information within the packet.
Finally, to ensure the closing sale is handled smoothly and successfully with full transparency, the new homebuyer(s) should have a full understanding of you transferring property ownership and membership responsibility.
